Product prices are subject to change at any time without notice. The price shown in your order confirmation email is the price at which you will purchase. Should an error exist in our pricing system, we reserve the right to cancel the order or charge the correct price before the order is processed.

We accept orders only from customers in certain countries and only ship to addresses within the country from which the order was placed. The countries to which we currently ship are:

• All Member States of the European Union/ EEA
• Other countries upon request (verification required)

Right to Refuse: We reserve the right to refuse any order at our sole discretion. This applies in particular to:

• Orders with invalid or incomplete billing information
• Orders that appear fraudulent or violate our policies
• Orders to addresses in countries where we do not ship
• Orders to addresses where shipment is impossible

3.2 Order and Contract Formation

Order Process:

1. You browse the Website and select products
2. You add products to your shopping cart
3. You enter shipping, billing, and payment information
4. You confirm your order on the order confirmation page
5. By clicking "Complete Order", you submit a binding offer to BLACKEAGLE s.r.o.

Contract Formation: The contract between you and BLACKEAGLE s.r.o. is formed when we accept your order and send an order confirmation to the email address you provided. This confirmation contains:

• Confirmation of your order
• List of products ordered
• Total purchase price
• Shipping and delivery information
• Invoice details

Order Acceptance: If we cannot accept your order (e.g., product not available, payment problem), we will notify you by email and refund any payments.

3.3 Payment Obligation

By submitting an order, you agree to:

• Pay the purchase price for the products selected
• Pay all applicable shipping and handling costs
• Pay all duties and/or taxes (if applicable)

The total price is stated in your order confirmation.

1. Take Photos: Document the damage with photos of the package and product
2. Notify Carrier: Report the damage to the carrier using the tracking number

   1. Order number
   2. Tracking number
   3. Photos of damage
   4. Description of the issue

6.1 European Union (EU)

For orders shipped to the EU, Value Added Tax (VAT) is included in the displayed price. No additional taxes are required.

6.2 Outside the European Union

Customers with a shipping address outside the European Union are responsible for:

• Customs Declaration: You must declare your package to local customs authorities

• Customs Fees: All customs duties, import taxes, and local taxes are your responsibility

• Refund Claim: Customs fees will NOT be refunded by BLACKEAGLE

Contact Customs: Please contact your local customs authorities to learn about expected customs fees.

6.3 Shipping Costs and Taxes

Shipping costs are displayed separately from product costs. Taxes (if applicable) are added to the total price before you pay. 

7.1 Cancellation Before Shipment

If you wish to cancel your order before shipment, you must contact BLACKEAGLE within 24 hours of placing the order. After that, cancellations cannot be guaranteed.

7.2 Returns and Refunds After Delivery

After delivery, returns and refunds are governed by our Return Policy. This policy describes:

7.3 Your Legal Rights

These Terms do not affect your legal return or refund rights in your country. In particular, for products purchased in the EU:

8.1 Limited Warranty

Our Warranty Policy describes the conditions and procedures for obtaining warranty service. This warranty:

8.2 Warranty and Legal Rights

Our limited warranty is an additional protection to all statutory warranty rights in your country. This means:

• Nothing in these Terms limits your legal rights

• In case of conflict, the most favorable terms for you apply

8.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

BLACKEAGLE is NOT liable for:

• Indirect Damages: Lost profits, lost revenue, business interruption

• Consequential Damages: Damages resulting from other damages

• Punitive Damages: Additional compensation beyond refunds

• Data Loss: Damaged or lost content

Maximum Liability: BLACKEAGLE's maximum total liability is limited to the purchase price of the affected product.

Exceptions: This limitation of liability does not apply to:

• Violation of consumer protection laws

• Personal injury or death

• Fraudulent misrepresentation or intentional negligence

• Violation of mandatory law

9.1 Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable:

• That provision will be upheld to the fullest extent permitted by law

• The remaining provisions will remain in full force and effect

• These Terms are not intended to override mandatory laws

9.2 Entire Agreement

These Terms and any additional terms referenced herein, as well as any terms specified on the "Review Your Order" page or in our order confirmation, constitute the entire agreement between you and BLACKEAGLE and supersede:

• All previous agreements or understandings

• All previous versions of these Terms

• All oral agreements

9.3 Your Rights Under Law

These Terms DO NOT affect your legal rights under the laws of your country of residence. In particular:

• Mandatory Rights: These Terms cannot override mandatory consumer rights

• Right of Return: You retain your right of return under applicable laws

• Warranty: Statutory warranty rights apply in addition to this Agreement

9.4 Severability of Provisions

If any provision of these Terms is found invalid under applicable law, that provision will be upheld to the fullest extent permitted by law. All other provisions remain valid unchanged.

We may change the content of our Website and these Terms at any time at our sole discretion. By continuing to use the Website, you accept the modified Terms.

12.2 Jurisdiction and Venue

• For EU Consumers: All disputes shall be heard in the courts of your country of residence

• For Other Customers: All disputes shall be heard in the courts of the Czech Republic

• Arbitration: We also accept arbitration at your request

12.3 Consumer Protection Laws

These Terms are interpreted in full compliance with consumer protection laws in your jurisdiction. If any provision of these Terms violates consumer protection laws, the consumer protection law applies instead.
